The Bill (Reg. No. 1466) envisages more extended definition of the term "land relations" and its coordination with other regulations of the Land Code of Ukraine.
Pursuant to the Bill, "land relations designate a scope of social relations appertaining to ownership, use and disposal of land granted to the Ukrainian nation, with their further delegation to the public and local self-government bodies in accordance with the Constitution of Ukraine; and other social relations based on land".
The People´s Deputy, Zoya Shyshkina, the author of the Bill, states that the Land Code of Ukraine includes mutually exclusive regulations that radically contradict the doctrine on land legal relations and, in particular, on legal relations concerning land ownership, categories of land and land plots.
Therefore, legislative definition of land relations lacks the following important components: subject and object composition related to the form of ownership, owners of particular land, categories of land and land plots, peculiarities of judicial personality and specific content of legal relations.
Zoya Shyshkina emphasizes the urgent need to amend Article 2 of the Land Code of Ukraine, specifying the concept "land relations".
